Terms of Sale

  1. Scope

The website (“Website”) is published by Massi Hotels, a hotel and villa operator under Massi Turizm Ticaret Anonim Şirketi. Massi Hotels provides hotel and villa promotion and reservation referral services through the Website, in accordance with the terms and conditions set forth in these Sales Terms.

The Services are only provided to individuals who are legally authorized to enter into legally binding contracts under applicable law (“Customer”). By using the Services, the Customer represents and warrants that he/she is legally of age to use the Services and to create legally binding obligations in connection with any liability that may arise from the use of the Services. In addition, the Customer undertakes to represent that he/she is authorized to make reservations on behalf of himself/herself or others.

These sales terms (“Sales Terms”) apply to reservations made by the Customer through the Reservation Sites for any of the following Massi hotels and villas:

Massi Near The Sea Hotel/Villa

Massi Selimiye Villa

Massi Sögüt Villa

Massi Ayağacı Hotel

(each separately referred to as the “Hotel” or “Villa,” together as “Hotels” or “Villas”).

Reservations made at any other hotel or villa owned by Massi Turizm Ticaret Anomim Şirketi will be processed by Massi Turizm Ticaret Anomim Şirketi and Customers will be redirected to the website of the Authorized Reservation companies to make their reservations in accordance with Massi Hotels terms and conditions.

The Sales Terms regulate the contractual relationship between the Customer and the Hotel where the Customer makes a reservation. The Sales Terms are made available to the Customer on the Reservation Website and can be accessed at any time. Customers can save and/or print the Sales Terms by using the general settings of their Internet browser and/or computer.

The Sales Terms prevail over and are superior to any other document related to their subject matter. The parties expressly declare that all provisions related to the subject matter of the Sales Terms are governed by this agreement. Any general or specific provisions provided by the Customer cannot be included in or added to these terms and conditions.

By accepting these Sales Terms, the Customer declares that he/she is legally of age, has legal capacity to enter into this agreement, and that he/she is acting for his/her own needs, except for intermediary, resale, distribution or similar acts for all or part of the Services.

Massi Hotels reserves the right to change these Sales Terms at any time. The Sales Terms in effect on the reservation date shall apply. The Customer accepts the promotion and referral site and the Reservation System.

  1. Service Definitions

The Internet Site provides guidance and promotion for Customers to make reservations at Hotels and Villas. The basic features and qualities of the Hotels and/or Villas’ facilities are presented on the Internet Site prior to and/or during the reservation process. If the Customer needs more information about the services provided at the Hotels and/or Villas, they can contact Massi using the contact information provided on the Internet Site.

The photos displayed on the Internet Site are for informational purposes only. Although every effort is made to provide an accurate impression of the services offered in the graphic representations, photographs, and written descriptions produced to depict and show the services provided at the Hotels and/or Villas, differences may occur, especially due to changes in furniture and furnishings or possible renovations.

In case of doubt or to obtain more information about the services, please contact the Hotel using the contact information provided on the Internet Site. In any case, Massi Hotels and/or Villas cannot be held responsible for minor errors that may arise in this regard.

In any case, the following information is provided to Customers on Massi’s Internet Site and Reservation Sites:

The Customer is solely responsible for their service selections and their suitability for their needs. The Hotels and/or Villas cannot be held responsible for this. It is explicitly accepted that all reservations are specific to the individual and cannot be transferred, partially or wholly, to third parties under any circumstances.

  1. Sales Terms

Any reservation made implies that the Sales Terms and Conditions have been previously reviewed and accepted by the Customer through a checkbox containing a link to these documents.

Massi cannot be held responsible for incorrect or incomplete information provided by the Customer during the reservation process.

The reservation process is dependent on the reservation flow of the Reservation websites directed by Massi, outside of the Massi website. The steps to be taken on the website are as follows:

The customer selects the hotel or villa they want to stay in and can make a reservation by filling out the reservation form or by contacting a Massi Hotels reservation representative via phone.

The customer indicates their check-in and check-out dates, specifies the number of adults and/or children related to the reservation, and then submits the reservation form by clicking on the “send reservation form” button.

The customer selects from room types and villas, and then submits the “reservation” procedures via the form.

A summary of the reservation made by the customer is sent to the email address specified in the form, and the customer has the right to make any necessary changes to the reservation by contacting Massi.

The customer fills out their own contact information in the “reservation form” (mandatory fields are marked with an asterisk).

The customer does not perform credit card transactions on the Massi website. They can use the credit cards specified on the reservation sites that are directed to them.

The customer clicks on the “I have read and agree to the Sales Terms and Conditions” button on the reservation form accessible through the connection tool on the directed reservation site.

The customer clicks on the “book now” button on the directed reservation site.

No payment will be made through the Internet Site. Credit card information may only be required to secure the reservation in accordance with the guidelines on the reservation site that Massi directs.

If the customer completes the reservation process through the Internet Site as specified above, they will receive a confirmation email that provides detailed information about their reservation. Depending on the Sales Terms and Conditions that apply to the reservation, if a deposit is required for the reservation, Massi will provide the necessary guidance to the company providing the reservation system for the customer to make the deposit payment to Massi. In this context, prepaid reservations will only be considered confirmed once the customer has made the relevant payment.

Massi reserves the right to refuse or cancel a reservation based on legitimate reasons such as an unusual number of reservation requests or disputes with the customer regarding previous reservations.

4. Right of Withdrawal

If the reservation is cancelled according to the reservation process described in Article 3 of this agreement, the provisions of the Law on the Protection of the Consumer in Turkey shall apply to the right of withdrawal.

5. Cancellation/Change

According to the Sales Terms and Conditions, Massi reserves the right to apply a cancellation fee and obtain a portion or the entire amount of the fee that the Customer is required to pay for the reservation, which was previously paid or, where applicable, offset from the amounts provided as collateral (if the reservation fee has not been paid in advance) in applicable cases. Reservations or payments that are not made in accordance with the rules, are invalid, incomplete or fraudulent, may result in the cancellation of the reservation, with Massi retaining its compensation and/or other rights at the hotels and/or villas.

6. Absence from Reservation

If the customer does not show up for the reservation (if the reservation is not canceled and the customer does not arrive for the accommodation):

If the customer has made a prepayment as stated in the relevant article, the relevant prepayment will be withheld by Massi,
If the reservation has been secured only by credit card, a compensation fee equal to the reservation fee will be charged from the customer’s credit card.

Unless otherwise stated, the customer’s reservation will be canceled under the Sales Conditions without any payment.

  1. Prices and Payment

7.1. Prices

The applicable prices are displayed on the reservation website guidelines before the reservation process and during the reservation. Prices are shown as room rates according to the number of people and selected dates. The prices shown on the directed reservation website are in the currency selected by the customer and include all taxes applicable at the time of reservation, including VAT. If the payment to the hotel is made in a currency other than the one selected by the customer, the currency exchange fees will be borne by the customer.

Unless otherwise specified in the Price Policy or during the reservation process on the Reservation website, additional services such as dry cleaning, breakfast, half board, full board, etc. are not included in the price.

Massi may change the prices on its website at any time. Reservations will be invoiced based on the prices valid at the time of reservation confirmation by the customer.

7.2. Payment

During the reservation process, the customer can choose one of the payment methods specified, such as credit card or bank transfer. When paying by credit card, credit card information is required to complete the reservation process, and the card information is securely deleted after the transaction is completed.

After the reservation is confirmed, an invoice will be sent to the customer via email. Payment must be made within 7 days from the invoice date. If payment is not completed, the reservation will be automatically canceled.

If the period between the reservation date and the accommodation date is more than 30 days, the customer must make a 30% advance payment within 7 days of the reservation confirmation. If the advance payment is not made, the reservation will be automatically canceled.

The owner of the credit card used for payment must be the same person who will be staying. Massi is not responsible if the customer provides incorrect information during the reservation process.

After the customer makes the payment, Massi has a 3 (three) business day period to confirm the payment. The payment confirmation is indicated on the invoice sent to the customer.

7.3. Payment Terms

The payment terms may vary depending on the Sales Conditions applicable to the customer’s reservation. In any case, in order to secure their reservations, when making a reservation online through the reservation website, the customer will be asked for their credit card information. Additionally, some fees may require a prepayment, while other fees will be paid directly and entirely to Massi during the customer’s stay.

If a customer makes a reservation for multiple rooms but only one or some of these rooms or villas require a prepayment, the credit card used for the prepayment will be used as a guarantee for the other rooms.

7.3.1. Prepayment

If the fee is subject to a prepayment under the Sales Conditions, a payment link with prepayment instructions will be sent to the customer’s email address. If the customer does not make the relevant prepayment within forty-eight (48) hours from the time the payment link is sent to them, the reservation will be canceled, and an email informing the customer of the cancellation will be sent.

The accepted payment method is a credit card (Visa, Mastercard, American Express).

If the prepayment process is completed by the customers, a confirmation email verifying the payment will be sent to their email addresses.

7.3.2. Deposit

If the fee is not subject to a prepayment, the payment related to the reservation will be made directly to Massi by the customer during their stay. In such a case, to secure the payment for the services provided by the hotel, the hotel may request authorization to collect a deposit or charge the credit card of the customer upon check-in.

Massi hotels and/or villas inform customers that they process their personal data in accordance with the Massi Privacy Policy, which is accessible from the website. Privacy policy

  1. Force Majeure

In accordance with the definition provided in the Turkish Civil Code and domestic case law, in the event of the occurrence of a force majeure that prevents either party from fulfilling its obligations arising from the contract, the relevant obligations of the parties will be suspended, and neither party will be held responsible for this situation.

The affected party by force majeure will notify the other party of the force majeure as soon as possible after its occurrence.

If the force majeure persists uninterrupted for more than thirty (30) days and/or if it prevents the affected party from fulfilling its obligations under this agreement in an absolute and definitive manner, the other party will have the right to terminate this agreement by sending a registered letter to the affected party, notifying them in writing of the termination. The termination will take effect from the date of the delivery of the relevant registered letter, and neither party will be held responsible for this situation.

  1. Resolution of Disputes

These Sales Conditions are subject to Turkish law and will be interpreted in accordance with Turkish law.

In the event of a complaint or dispute regarding these Sales Conditions and/or the reservation, the customer can contact Massi Customer Service (by email at [email protected] or by phone at +90 532 111 2448 (Monday to Sunday, 08:00 – 00:00 (Istanbul time))) to try to find an amicable solution with Massi.

If the complaint cannot be resolved amicably by Massi Customer Service, the customer can make a complaint to the Consumer Commission online dispute resolution platform accessible at Tüketici Komisyonu online uyuşmazlıkları çözümü platformu – e-Devlet › tuketici-sikayeti-uygulaması.

In the event of failure to reach an amicable solution (including the aforementioned mediation process) or if the customer wishes to file a claim or dispute related to their demands or the dispute, the customer has the right to file a lawsuit at their discretion under the Turkish Consumer Protection Law, either at their residence or in any court that has jurisdiction under the Code of Civil Procedure. However, the resolution of any complaint or dispute related to these Sales Conditions and/or the reservation will be exclusively subject to the Istanbul courts.

  1. Other Provisions

The parties explicitly declare that these Sales Conditions constitute the entire agreement between the parties regarding the subject matter, and replace any other agreements entered into between the parties regarding this subject matter. If any provision of this agreement is found to be invalid, the relevant provision will not be applied, but the other provisions will remain in effect.

A failure by one of the parties to notify the other party regarding the failure to fulfill any of their obligations does not constitute a waiver of that obligation, nor does it prevent the other party from making such a notification in the future. Such failure cannot be interpreted as an amendment to the Sales Conditions.

If any of the provisions of the Sales Conditions is declared invalid or is invalidated or declared illegal by the competent court or regulatory authority based on any law, regulation or regulation, the parties shall meet to determine new provisions that will replace the invalid or annulled provisions and that will ensure that the main purpose of the provision or provisions in question is realized as much as possible. The remaining provisions of the agreement shall remain in effect.
